The Senate met at 6 p.m.
(Senator Tomblin, Mr. President, in the Chair.)
Prayer was offered by the Honorable Mike Hall, a senator from
the fourth district.
Pending the reading of the Journal of Tuesday, March 11, 2008,
On motion of Senator Wells, the Journal was approved and the
further reading thereof dispensed with.
The Senate proceeded to the third order of business.
Executive Communications
The Clerk then presented communications from His Excellency,
the Governor, advising that on March 10, 2008, he had approved Enr.
Committee Substitute for Senate Bill No. 579, Enr. House Bill No.
2503 and Enr. Committee Substitute for House Bill No. 4076.
The Senate proceeded to the fourth order of business.
Senator White, from the Joint Committee on Enrolled Bills,
submitted the following report, which was received:
Your Joint Committee on Enrolled Bills has examined, found
truly enrolled, and on the 11th day of March, 2008, presented to
His Excellency, the Governor, for his action, the following bills, signed by the President of the Senate and the Speaker of the House
of Delegates:
(Com. Sub. for H. B. No. 3065), Relating to making false
reports of child abuse, sexual abuse and domestic violence.
(H. B. No. 4085), Relating to regulatory review of the West
Virginia Acupuncture Board.
(Com. Sub. for H. B. No. 4244), Authorizing the Department of
Transportation to promulgate legislative rules.
(Com. Sub. for H. B. No. 4368), Reducing acts of student
violence and disruptive behavior and increasing penalties for
chronically disruptive students.
(Com. Sub. for H. B. No. 4423), Ensuring that beer kegs are
not considered scrap metal unless received directly from a beer
manufacturer.
(H. B. No. 4464), Adding more exemptions to the requirement
that a foreign corporation obtain a certificate of authority before
conducting affairs in the state.
(H. B. No. 4512), Providing classifications of licensees to be
licensed by the State Fire Marshal to engage in fire protection
work.
(H. B. No. 4628), Providing a tax credit for new job creation
by certain taxpayers.

Senator Chafin then moved that the Senate adjourn until
tomorrow, Thursday, March 13, 2008, at 11 a.m.
The question being on the adoption of Senator Chafin's motion,
and on this question, Senator Chafin demanded the yeas and nays.
The roll being taken, the yeas were: Bailey, Boley, Bowman,
Caruth, Chafin, Edgell, Facemyer, Fanning, Foster, Green, Guills,
Hall, Helmick, Jenkins, Kessler, Love, McCabe, Minard, Plymale,
Prezioso, Stollings, Sypolt, Wells, White and Tomblin (Mr.
President)--25.
The nays were: Barnes, Deem, Hunter, McKenzie, Oliverio,
Sprouse, Unger and Yoder--8.
Absent: Sharpe--1.
So, a majority of those present and voting having voted in the
affirmative, the President declared Senator Chafin's motion had
prevailed.
In accordance with the foregoing motion, the Senate adjourned
until tomorrow, Thursday, March 13, 2008, at 11 a.m.
